Employment Law

We represent both employers and employees in a variety of employment matters. As outside general counsel to companies across many industries, we support the human resource and executive teams in drafting employee handbooks and personnel policies, advising on hiring, disciplinary and termination procedures, employee benefits, and assisting with other personnel matters.  We help ensure compliance with various state and federal employment laws, such as the Massachusetts sick leave and parental leave laws, medical marijuana laws, ADA, COBRA, OSHA and anti-discrimination laws, by drafting employment policies that maximize production and minimize the risk and expense of potential employee claims.

We also represent high-level executives in the drafting, review and negotiation of employment agreements, non-compete agreements, equity plans and termination agreements.

When litigation is necessary, we represent our clients in proceedings before the Massachusetts Commission Against Discrimination (MCAD), the U.S. Equal Employment Opportunity Commission (EEOC), the Massachusetts Department of Labor, the Massachusetts Department of Unemployment Assistance, as well as in state and federal court.  We also handle investigations by the Attorney General’s Office and Department of Labor on wage and hour issues. 

Recent Cases

  • Minority Shareholder and Executive Employment - Wrongful Termination
     - We represented a minority shareholder in litigation against his former company, resulting in a settlement of approximately $1,000,000.
  • Wrongful Discharge of Senior Executive
     - We represented a senior executive in an employment dispute resulting in a severance agreement and payment of approximately $450,000.
  • Wrongful Discharge of Physician
     - We represented a physician in a dispute with her employer, resulting in severance agreement and payment of approximately $200,000.
  • Gender Discrimination and Sexual Harassment
    - We successfully represented an employee in a sexual harassment hearing at MCAD against her former employer and the company President, resulting in an award of $75,000 plus attorneys' fees and a $10,000 civil penalty.
  • Wrongful Discharge of Physician
     - We represented a physician in a dispute with her employer, resulting in a severance agreement and payment of approximately $200,000.
